Terms of Use

1. What VibeDraft Is

VibeDraft is a web-based app concept planning tool that helps you plan, structure, and export your app ideas before prompting an AI assistant. It includes AI-powered features that use the Anthropic API to generate suggestions, expand notes, and create app maps.

2. Eligibility

You must be at least 18 years old to use VibeDraft. By creating an account, you confirm that you meet this requirement and that the information you provide is accurate.

3. Acceptable Use

VibeDraft is intended for legitimate app planning and development purposes. You agree not to use the service to:

• Plan, develop, or facilitate illegal activities or harm to others
• Submit content that is offensive, abusive, hateful, or sexually explicit
• Attempt to circumvent or abuse the AI content moderation system
• Attempt to access another user's account or data
• Reverse engineer, scrape, or copy any part of the service
• Use the service in any way that violates applicable law

Content that causes our AI provider (Anthropic) to refuse a request due to policy violations will be treated as a usage policy violation on your account.

4. Content Moderation & Enforcement

We operate an automated content moderation system. When the AI detects or refuses content that violates our usage policy, the following actions may be taken:

• Warning 1–2: You will receive a warning with the count displayed
• Warning 3 (First suspension): Your account will be suspended for 7 days. All AI features will be unavailable during this period.
• Second suspension: Your account will be permanently banned. All personal data and projects will be deleted. Your email and IP addresses will be retained to prevent re-registration.

If you believe an action was taken in error, contact us via our Discord server.

5. Subscriptions & Payments

VibeDraft offers a free plan and a paid Pro plan. Payments are processed by Stripe. By subscribing to Pro, you authorise us to charge your payment method on a recurring basis (monthly or annually) until you cancel.

• Early Adopter subscribers lock in their pricing permanently
• You may cancel your subscription at any time through Stripe's customer portal
• We do not offer refunds for partial billing periods
• Prices may change for new subscribers with reasonable notice

6. Account Termination

You may delete your account at any time from the Settings screen. We reserve the right to suspend or terminate accounts that violate these terms. Upon permanent ban, personal data is deleted except for email and IP addresses retained to enforce the ban.

7. Disclaimer of Warranties

VibeDraft is provided "as is" without warranty of any kind. We do not guarantee that the service will be uninterrupted, error-free, or that AI-generated content will be accurate or suitable for your purposes. Use AI output with appropriate judgment.

8. Limitation of Liability

To the maximum extent permitted by law, Zenith Engineering Solutions LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of VibeDraft.

9. Changes to These Terms

We may update these terms at any time. Continued use of the service after changes constitutes acceptance. Material changes will be announced in our Discord server.

10. Governing Law

These terms are governed by the laws of the State of Michigan, United States, without regard to conflict of law principles.

Privacy Policy

1. What We Collect

When you use VibeDraft, we collect the following information:

• Account information: Your email address and password (hashed, never stored in plain text)
• Project data: Everything you create in VibeDraft — notes, features, maps, pages, workflow steps
• Usage data: AI credit usage, approximate daily AI cost per user
• IP addresses: We log every unique IP address used to access your account. This is used for security and to enforce bans.
• Payment information: Handled entirely by Stripe. We store only your Stripe customer ID and subscription price ID — never your card details.

2. How We Use Your Data

• To provide and operate the VibeDraft service
• To process payments and manage your subscription
• To enforce our content moderation and usage policies
• To send AI requests to Anthropic on your behalf
• To improve the service based on usage patterns

3. AI Processing

When you use AI features, your project data and notes are sent to Anthropic's API to generate responses. This processing is governed by Anthropic's Privacy Policy. We do not use your data to train AI models.

4. Data Storage

Your data is stored in Supabase (PostgreSQL database) hosted in the United States. By using VibeDraft, you consent to your data being stored and processed in the United States.

5. Data Sharing

We do not sell your personal data. We share data only with:

• Supabase — database and authentication provider
• Anthropic — AI processing for AI features
• Stripe — payment processing
• Cloudflare — hosting, CDN, and serverless Workers

We may disclose data if required by law or to protect the rights and safety of our users.

6. Data Retention

• Active accounts: data retained until you delete your account
• Deleted accounts: data removed within 30 days
• Banned accounts: email and IP addresses retained indefinitely to enforce the ban. All other data is deleted immediately upon ban.

7. Your Rights

You have the right to:

• Access and export your project data at any time via the Export tab
• Delete your account and all associated data from the Settings screen
• Request a copy of data we hold about you by contacting us via Discord

8. Cookies & Tracking

VibeDraft uses only essential cookies for authentication (managed by Supabase). We do not use advertising cookies or third-party tracking.

9. Children's Privacy

VibeDraft is not intended for users under 18 years of age. We do not knowingly collect data from minors.
